In 2007, the First Nations Child and Family Caring Society (FNCFCS) headed by Dr. Cindy Blackstock, filed a discrimination complaint with the Canadian Human Rights Commission. In 2016, the Canadian Human Rights Tribunal has found Canada guilty of racial discrimination against First Nations children in foster care for underfunding their services compared to those of Canadian children.

Canada has failed to fully comply with the order of the Tribunal which has issued 8 non-compliance orders against Canada. The most recent order directs Canada to compensate the children victims in the amount of $40,000 CAD each. Canada continues to battle these children and has applied (and was denied) a stay (delay of decision) and has another proceeding trying to quash (overturn) the decision.
