City loses bid to re-open swing bridge – The Chronicle Journal

The City of Thunder Bay has lost its bid to have CN Rail re-open the James Street bridge to public traffic. But it has not ruled out further efforts to get the roadway portion of the bridge, damaged by a minor fire in 2013, returned to use by vehicles.
In his 28-page ruling, Superior Court Justice Patrick Smith says the city failed to make the case that CN should make structural improvements to render the bridge safe for public use.
He termed as “vague” key portions of the city’s case that could potentially open itself and CN to action for negligence over safety issues.
CN told the court that it decided to close the bridge after the fire when an inspection identified “serious safety risk” around multiple bridge components that no longer meet current codes.
