Tuesday’s ruling by the B.C. Court of Appeal that directs the B.C. provincial government to reconsider its environmental certificates for the Trans Mountain expansion project is yet another legal frustration in this long, tortuous process. But it’s not a big blow to the pipeline. Even the anti-Trans Mountain B.C. government recognizes that.
It’s almost more like a housekeeping matter.
A three-judge panel, in a unanimous decision, agreed that the current provincial environmental assessment certificates — issued before the B.C. NDP government took office in 2017 — had become stale-dated, as it were. Those certificates were issued prior to last August when the Federal Court struck down Ottawa’s first approval of Trans Mountain.
