Wills & Estates: The Role of the Executor

This two-day workshop on the Role of an Executor is designed to provide individuals with an understanding of the work involved in being an Executor and Trustee in the administration of Estates and Testamentary Trusts, as well as a basic grounding in Wills and Will Interpretation. You will also learn about the legal and tax environment, and the level of competence required to be an Executor.

Workshop Learning Objectives:

OBJECTIVE 1        Wills – Identify the importance of having a Will, the different types of Wills and the requirements to make a Will legal. It is important before you step into the role of an Executor to have a basic understanding of Wills.

OBJECTIVE 2        Dying Intestate or Without a Will – Identify the steps necessary to administer an estate of a person you has died without a Will and how property is divided when a person dies Intestate.

OBJECTIVE 3        Estate Administration – Identify how to administer an estate, the treatment of debts after death, choosing the right executor, the duties of the executor, and much more.

OBJECTIVE 4        Estate Accounting – Identify what accounting is required for taxes, the court and beneficiaries.

OBJECTIVE 5        Probating a Will – Identify when a Will needs to be probated and the necessary steps to probate a Will.

OBJECTIVE 6        Administering an Indian Act Estate – identify the steps necessary to administer an estate based on the Indian Act on how to administer an estate of an Indian who lived on Reserve or on Crown lands when he or she died.

OBJECTIVE 7        Estates with a Business Interest – Identify you should be able to identify a few different business structures and what is required of you as the executor.

OBJECTIVE 8        Taxation of an Estate – Identify what is considered taxable and what is considered non-taxable.  What returns are required and what is a final clearance certificate.
