Regulations enacted for the Kahnawà:ke Cannabis Control Law

(Kahnawake – 20, Kenténha/October 2021) The Mohawk Council of Kahnawà:ke wishes to inform the community that certain regulations pursuant to the Kahnawà:ke Cannabis Control Law were enacted at Monday’s duly-convened Council Meeting. The Mohawk Council of Kahnawà:ke Executive Directive (MCED #82/2021-2022) was passed by consensus and will enact the following regulations:

  • Regulation concerning Licensing Requirements and Procedures
  • Regulation concerning Cultivation, Processing and Distribution
  • Regulation concerning Prices, Royalties and Contributions

The regulations concerning Dispensaries and Dispensary Licenses (retail) will be enacted at a later date.

Additionally, the moratorium on the production, distribution and sale of cannabis within the Territory that was declared in 2017 (MCED 48/2017-2018) will be partially lifted in relation to cultivation and processing ONLY, under license by the Kahnawà:ke Cannabis Control Board. The moratorium in relation to retail sale and distribution remains in effect, with the exception of lawful import and export of cannabis for the sole purposes of processing.

“It has been a very long road to get here, and I would like to thank the community for its patience. There is still work to be done for the full implementation of the Cannabis Control Law, but with the enactment of these particular regulations, those interested in the industry can now look forward to the opportunities it presents. Moreover, the community can rest assured that the industry will be carried out in a safe and secure manner and that the economic benefits, spin-off industries, and employment opportunities it presents will benefit all Kahnawa’kehró:non,” said Ietsénhaienhs Tonya Perron.

The regulations were posted for community review in October 2020. The recently enacted regulations will be posted on the Community Decision Making Process website shortly.

The official launch of the application process will be next Monday, October 25, 2021, at which time those interested in applying for this license can contact the Kahnawà:ke Cannabis Control Office via email at cannabis.board@mck.ca or call 450-632-6201 for more details. Please note that only applications for licensing in the area of Cultivation and Processing will be accepted at this time.
