Hydro One would be seeking proposals from
- Manufacturer(s) (“OEM”), and/or
- Authorized dealer(s).
When the proponent responding to the RFP is the OEM itself, Hydro One expects that the fulfillment may be either directly by the OEM or through an authorized dealer, but in each such case, the contract would be with the OEM, and the dealer would act as the legal agent for the OEM (i.e. no separate contract would be required between the authorized dealer and Hydro One).
In all cases, the OEM must agree with Hydro One, either in the OEM contract with Hydro One or with a letter/certificate, to provide its authorized dealer with the trailers, equipment, cooperation, information, support, training, and parts necessary (including with respect to warranty) to allow the authorized dealer to fulfill its obligations to Hydro One in respect of the contract with Hydro One.
Hydro One’s intent coming out of this competitive procurement process is to secure one or more contracts (at Hydro One’s discretion) for each of the trailer classes for the supply of fleet trailers, on an as and when required basis throughout a multi-year contract term.
