Indigenous Self-Government at the Supreme Court of Canada
In this presentation, Dr. Hamilton will discuss a recent Supreme Court of Canada decision that considered federal approaches to recognizing Indigenous rights of self-government and addressed whether, or to what extent, the inherent right of self-government is protected as an Aboriginal right under the Canadian constitution. The case, which assessed the constitutionality of the Federal Act respecting First Nations, Inuit and Métis children, youth and families, illustrates the complicated relationships between Federal, Provincial, and Indigenous jurisdictions in Canada.
Robert Hamilton is an associate professor at the University of Calgary. His research focuses on legal dimensions of the relationships between Indigenous peoples and the state.
