SIU Concludes Investigation into Man’s Clavicle Fracture After NAPS Arrest
Mississauga, ON (May 27 , 2025)
The Special Investigations Unit found no reasonable grounds to believe a Nishnawbe-Aski Police Service (NAPS) officer committed a criminal offence in connection with a fractured right clavicle suffered by a 36-year-old man. On December 28, 2024, on a road in a First Nations community in the NAPS Northwest Region the man brandished a knife and refused to drop it. Officers discharged conducted energy weapons (CEW) at the man.
Director Joseph Martino was satisfied that the man’s behaviour rendered him subject to arrest for possessing a dangerous weapon. He concluded that the CEWs made sense as it had the capacity to temporarily immobilize the man from a distance, allowing the officers a safe window within which to approach and handcuff him.
It remained unclear if the man’s clavicle was broken due to the fall from the CEW deployments or occurred sometime afterward as medical evidence suggested the injury possibly post-dated his arrest by NAPS.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
